Compliance Bulletin: Annual Medicare Part D Notices Are Due by Oct. 15, 2019
Group health plan sponsors must provide the annual Medicare Part D creditable coverage disclosure notices to Medicare-eligible individuals before Oct. 15, 2019 – the start date of the annual enrollment period for Medicare Part D. The attached Compliance Bulletin summarizes the requirement to provide Medicare Part D notices, including the upcoming deadline, the availability of model notices and permissible ways to deliver the notices.
The Centers for Medicare & Medicaid Services (CMS) has provided two model notices (see attached) for employers to use:
- A Model Creditable Coverage Disclosure Notice; and
- A Model Non-Creditable Coverage Disclosure Notice.
These model notices are also available in Spanish on the CMS website.
PLEASE NOTE:
Employers are also required to provide a disclosure of creditable coverage status to CMS on an annual basis. Below is the link to the CMS Disclosure Form, which can be completed online.
